Terms And Conditions

Terms & Conditions GENERAL TERMS AND CONDITIONS

1. VALIDITY OF GENERAL TERMS AND CONDITIONS The following Terms and Conditions shall apply to all services rendered by KLS SOLE CO., LTD., LTD. hereafter referred to as EZConNek, in connection with the prepaid eSIM reselling. EZConNek may accept variant clauses only in the case of an explicit written agreement.

2. DESCRIPTION OF SERVICES

2.1. eSIM RESELLING EZConNek resells prepaid eSIMs.

2.2. REGISTRATION FOR USING EZConNek SERVICES The Customer must accept the General Terms and Conditions to use EZConNek services. The client gives directly or by the intermediary of the service provider (Hotel, Travel Agency…)

2.3. EZConNek ENGAGEMENTS EZConNek shall use reasonable endeavors to provide Customer quality service. However, EZConNek does not guarantee that the service will not be interrupted, provided on time, and be safe or fault-free.

2.4. CUSTOMER ENGAGEMENTS In using the Equipment or Services provided by EZConNek, the Customer must not engage in any action: that is abusive, illegal, or fraudulent; that causes the Network to be impaired or damaged.

When the Customer breaches its obligations under Sec. 2.4, EZConNek may suspend the Customers use of the Service. During any period of suspension, the Customer shall continue to pay all Charges due under this Agreement in respect of the suspended Services.

2.5. DEVICE COMPATIBILITY The Customer is responsible for ensuring that their device is eSIM compatible and network-unlocked. Device compatibility may depend on the carrier and country of origin, the Customer must check the list of eSIM-compatible devices provided at the checkout. By checking the box that confirms that the Customers device is eSIM compatible, the Customer is then held responsible for the accuracy of the information they provide. The eSIM compatibility list is not exhaustive, meaning newly announced eSIM-compatible devices may still need to be added.

3. START, DURATION, AND TERMINATION OF THE CONTRACT The Activation of the eSIM and acknowledgment of the Activation Policy is the Customers responsibility. The contract will be terminated if the Customer does not have an active data package or has deleted the eSIM from the target device.

4. CHARGES AND PAYMENT

4.1. PAYMENT CONDITIONS The supported payment methods for EZConNek services are Credit/Debit Card, PayPal, Google Pay, Apple Pay, and Alipay. The currency of payment is in US Dollars($).

4.2.1. EZConNek states all Charges are inclusive of VAT unless otherwise specified.

4.2.2. The Customer shall not be entitled to offset any of its claims against claims of EZConNek, except where the Customers claims are undisputed or have been confirmed by final court judgment.

5. DELIVERY The Customer will immediately see the purchased eSIM under the My eSIMs tab on the EZConNek app. The Customer will receive a confirmation email after the purchase. All the information for installing the eSIM will be available only on the users EZConNek account.

6. REFUND / CANCELLATION / MODIFICATION POLICY The Customer has the right to ask for a refund or eSIM-replacement if the eSIM cannot be installed and used due to a technical problem from EZConNek.

6.1. REFUNDS AND CANCELLATION

6.1.1. POLICIES AND GUIDELINES

6.1.2. A refund request can be made within thirty (30) days from the date of purchase when the activation is no longer possible following extensive collaborative troubleshooting.

6.1.3. Cooperation with the Customer to resolve the issue promptly is required for a refund to be granted

6.1.4. Each data package has its own validity period. No refund of any form will be offered for the remaining data when the validity period expires.

6.1.5. Compensation: No refund or remuneration of any kind will be issued due to charges from alternate phones, alternate SIM cards, alternate providers, hotel phones, or other charges that are not directly linked to the Customers EZConNek eSIM account. (See section 7. LIABILITY AND WARRANTY in our Terms and Conditions)

6.1.6. Fraudulent purchases: EZConNek reserves the right to refuse any form of refund if there is evidence of abuse, violation of our Terms and Conditions, or any fraudulent activity connected with using EZConNek products and services.

6.1.7.Unauthorized purchases: The case will be subject to investigation and approval before processing any refund. EZConNek reserves the right to suspend any account associated with fraudulent activity.

6.1.8. Accidental purchases: Once Customers install the eSIM, it will be considered used. No refunds will be offered.

6.1.9. Incorrect charges: If the Customer reasonably and in good faith disputes an invoice or part of it, the Customer shall notify EZConNek of such a dispute within twelve (12) days of receipt of the invoice, providing details of why the invoiced amount is incorrect and, if possible, how much the Customer considers due. (See details in section 4.2 CHARGES FOR USE under Terms and Conditions)

6.1.10. Other Reasons: If the refund request is not within the above, we will investigate the request on a case-by-case basis. If the refund is approved, a processing fee may apply. The maximum refund of credit a Customer can apply for must be equal to or less than the total amount they paid.

6.1.11. REFUND PROCESS To request a refund, contact EZConNek support team via the Contact Us page or send a message to [email protected]. Please be aware that our refund policy above will apply. Depending on the nature of the issue, Customers will be asked for further information to support their refund request, such as screenshots of the device settings for technical issues or details of why the invoiced amount is incorrect and, if possible, how much the Customer considers is due, etc. Please refer to section 6.1.2 in this same document for refunds related to technical issues. Refund to the original method: Once a refund is approved and issued, it can take up to thirty (30) business days to appear on a statement depending on the bank.

6.2. MODIFICATION The eSIM data packages from EZConNek are offered as-is, and no further modifications or customization can be made based on individual requests once purchased.

7. LIABILITY AND WARRANTY EZConNek is not responsible for detriments arising due to the proposed service not being constantly available. EZConNek provides no guarantee of constant availability of the network service.

EZConNek may change this privacy policy from time to time, in its sole discretion, as discussed in section ‘9. Changes to This Policy’ below. By registering an account or otherwise using or visiting any EZConNek website, application, product, software, tool, data feed, and/or service (collectively the “Service”), you understand and agree to the terms of this policy. EZConNek is committed to your privacy. This privacy notice explains how we collect, use, disclose, retain, and protect your personal information.

A few key principles regarding GDPR;

A clear purpose: the controller must specifically inform the customer of the use he will make of his personal data by collecting them.

Relevant data: the controller must only collect data that is strictly necessary for his treatment; this is the principle of minimizing collection

The retention period: the personal data must be kept enough time to the controller to achieve its purpose; beyond that time, the data must be deleted.

The rights of individuals: individuals can exercise their rights over the personal data held by the controller: access, rectification or deletion.

1. What Information Do We Collect?

1.1. Personally-Identifiable Information

We may collect personally identifiable information when you specifically and knowingly provide it to us, for example when you sign up for our newsletter or chat, create an account, request more information on our contact us page, respond to a survey or questionnaire and provide personal information such as your email address, name, phone number or other information. Where applicable, personally identifiable information includes personal data as defined in applicable law.

This Privacy Policy does not apply to the privacy practices of third parties that we do not own or control, including but not limited to any third party websites, services, applications, online resources to which this Site may link or otherwise reference (collectively Third Party Services or TPS) that you may access through the Services. For example, the Services utilize the Facebook API Services as a TPS, and you are agreeing to be bound by the Facebook Terms of Service, Privacy Policy and API Services Terms of Service when engaging Facebook content and services through the Service. EZConNekdoes not consider personally identifiable information to include information that has been anonymized so that it does not allow a third party to identify a specific individual. We collect and use your personally-identifiable information to provide the services, operate and improve our service, provide customer service, perform research and analysis aimed at improving our products, service and technology, and display content that is customized to your interests and preferences.

You may always choose not to provide personally identifiable information, but if you choose so, certain parts of the Service may not be available to you. If you have registered an account with us, you will have agreed to provide your personally identifiable information in order to access the services. This consent provides us with the legal basis we require under applicable law to process your data. You maintain the right to withdraw such consent at any time. If you do not agree to our use of your personal data in line with this policy, please do not use our Services.

1.2. Sensitive Personal Data

Subject to the following paragraph, we ask that you do not send us, and you do not disclose, any sensitive personal data (e.g., social security numbers, information related to racial or ethnic origin, political opinions, religion or other beliefs, health, biometrics or genetic characteristics, criminal background or trade union membership) on or through the services or otherwise to us.

If you send or disclose any sensitive personal data to us when you submit content to the services, you consent to our processing and use of such sensitive personal data in accordance with this policy. If you do not consent to our processing and use of such sensitive personal data, you must not submit such content to us. Please note that even if these information are provided, we will not store them anywhere on our side.

1.3. Non-Personally-Identifiable Information

We may collect and aggregate non-personally identifiable information which is information which does not permit you to be identified or identifiable either by itself or in combination with other information available to a third party. This information may include information such as a website that referred you to us, your IP address, browser type and language, hardware types, geographic location, and access times and durations. We also may collect navigational information, including information about the service content or pages you view, the links you click, and other actions taken in connection with the service. We use this information to analyze usage patterns as part of making improvements to the Service.

We may also use pixel tags (which are also known as web beacons and clear GIFs) on the Services to track the actions of users on our sites and applications. EZConNekwill provide you with information about EZConNek data and how it will be used upon request. Should your data stored by EZConNekbe incorrect, EZConNekwill correct it. In addition, customers can view the data in their account that EZConNekhas stored about them and correct it if necessary.

Please note that your use of some of the Services may be ineffective upon opt-out. eKYC information: As part of our identity verification process, we may request that you complete an electronic Know Your Customer (eKYC) check. To complete this check, you will be required to submit a photograph of a valid passport, driving license, or national identity card, as well as a photograph of yourself. We have partnered with Jumio, a third-party eKYC provider, to assist us in verifying your identity. Your data will be transmitted directly to Jumio for the purpose of identity verification and will not be stored in our systems. We will only access your data at the time of purchase, and if necessary, share it with the network operators offering the eSIM requiring eKYC.

4. Disclosure

As a general rule, EZConNek will not disclose any of your personally identifiable information except under one of the following circumstances:

we have your permission, including the permission granted by your acceptance of this Privacy Policy; we determine in good faith that it is legally required to be revealed by any relevant statute, regulation, ordinance, rule, administrative or court order, decree, or subpoena; it is information that we determine must be disclosed to correct what we believe to be false or misleading information or to address activities that we believe to be manipulative, deceptive or otherwise a violation of law; where you are otherwise notified at the time we collect the data; where we need to share your information to provide the product or service you have requested;when such disclosure is made subject to confidentiality restrictions in connection with a sale, merger, transfer, exchange, or other disposition (whether of assets, stock, or otherwise) of all or a portion of the business conducted by EZConNek. EZConNek may share the non-personally identifiable information that EZConNekgathers, in aggregate form only, with advertisers and other partners.

5. Children’s Policy

The Terms of service clearly provide that Users must be (i) 18 or older, or (ii) 13 and older if either (a) an emancipated minor, or (b) he/she possess legal parental or guardian consent. EZConNekdoes not knowingly collect personally identifiable information from users under 13. In the event that we learn that we have collected any personal information from a user under the age of 13, we will attempt to identify and delete that information from our database.

6. International Usage

The Service is owned by EZConNekand may be accessed in Europe and abroad. For data protection purposes, EZConNek is the controller and, unless otherwise noted, is also the processor of data. Information collected may be retained, and may be stored, processed, accessed, and used in jurisdictions whose privacy laws may be different and less protective than those of your home jurisdiction.

EZConNek has also contracted with third party service providers to manage the logistics and customer support for an optimal 24/7 service. Some data needs to be disclosed and transferred to these third party to ensure the fulfilment of the service. All third party involved have been engaged under a binding confidentiality agreement and have a limited access to EZConNek database for the purposes of providing support.

We follow generally accepted industry standards to help protect your personal information. Our service has security measures in place designed to protect against the loss, misuse and alteration of the information under our control. We use standard Secure Socket Layer (SSL) encryption that encodes information for such transmissions. All service information is maintained on secure servers.
